Terms of Service

1. Agreement to Terms

By accessing and using Voguir Cover Model ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Eligibility

You must be at least 18 years old to register and participate in competitions on this Platform. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

3. Account Registration

To participate in competitions, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

4. Competition Rules

By entering any competition on the Platform, you agree to:

  • Submit only original content that you have the right to use
  • Not engage in any fraudulent or manipulative voting practices
  • Comply with all specific rules and requirements for each competition
  • Accept the judges' decisions as final and binding
  • Grant us the right to use your submitted content for promotional purposes

5. Content Ownership and License

You retain ownership of all content you submit to the Platform. However, by submitting content, you grant Voguir Cover Model a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with the Platform and our business.

6. Prohibited Conduct

You agree not to:

  • Use the Platform for any illegal purpose
  • Harass, abuse, or harm other users
  • Submit false, misleading, or fraudulent information
  • Attempt to manipulate voting or competition results
  • Interfere with the proper functioning of the Platform
  • Use automated systems or software to extract data from the Platform
  • Use automated systems or software to break voting rules and restrictions
  • Same person can cast only one free vote for the same contestant. More than one free vote is not allowed from the same person for the same contestant, even if the voter finds a way around the voting restrictions to cast duplicate/fraudulent votes

Not complying with the Terms of Service may result in the disqualification of the contestant without a warning and without a refund for the paid votes.

7. Prizes and Awards

Prize values and details are specified for each competition. Winners will be notified via email and must respond within the specified timeframe. Prizes are non-transferable and cannot be exchanged for cash unless explicitly stated. We reserve the right to substitute prizes of equal or greater value at our discretion.

8. Voting and Vote Purchases

The Platform offers free voting and paid voting packages. All vote purchases are final and non-refundable. We reserve the right to invalidate any votes obtained through fraudulent means and to disqualify participants who engage in such practices.

9. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR ANY TECHNICAL MALFUNCTIONS OR FAILURES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOGUIR COVER MODEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Voguir Cover Model and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
